Right of withdrawal
Instructions on the Right of Withdrawal
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
Withdrawal Period
The withdrawal period is fourteen days.
For a contract for the purchase of goods, the withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, takes possession of the goods.
If you ordered several goods as part of a single order and they are delivered separately, the withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, takes possession of the last item.
If goods are delivered in several separate shipments or pieces, the withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, takes possession of the last shipment or the last piece.
The withdrawal period does not begin before you have been properly informed of your statutory right of withdrawal.
Exercising Your Right of Withdrawal
To exercise your right of withdrawal, you must inform us at:
Oblivious GmbH
Ameisenbergstraße 36
70188 Stuttgart
Germany
Email: info@areweoblivious.com
by means of a clear statement informing us of your decision to withdraw from the contract.
For example, you may send us an email. You may also use our model withdrawal form, although use of this form is not mandatory.
In addition, you may exercise your right of withdrawal using the electronic “Withdraw from contract” function provided on our website.
If you use the electronic withdrawal function, we will send you an acknowledgement of receipt of your withdrawal without undue delay on a durable medium, for example by email. The acknowledgement will include the content of your withdrawal statement as well as the date and time on which it was submitted.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery method offered by us.
Any additional delivery costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us will not be reimbursed.
We will make the reimbursement without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal from this contract.
We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not incur any additional fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.
Returning the Goods
You must return or hand over the goods to us without undue delay and no later than fourteen days from the day on which you inform us of your withdrawal from the contract.
The deadline is met if you send the goods before the fourteen-day period has expired.
You are responsible for the direct cost of returning the goods.
We recommend using a trackable shipping method when returning goods. This recommendation does not affect your statutory right of withdrawal.
Inspection of the Goods and Diminished Value
You may handle and inspect the goods to the extent necessary to establish their nature, characteristics and functioning.
For clothing, this includes trying the item on in order to assess its size, fit, cut and appearance.
You will only be liable for any diminished value of the goods where that diminished value results from handling the goods beyond what is necessary to establish their nature, characteristics and functioning, provided that you have been properly informed of your right of withdrawal.
This may apply in particular where clothing has been actually worn or used beyond a normal fitting, or where it is returned with clear signs of wear, stains, make-up marks, odours, damage or other deterioration.
Such handling does not automatically result in the loss of the statutory right of withdrawal.
However, any actual diminished value caused by handling beyond what was necessary for inspection may be taken into account when calculating the reimbursement to the extent permitted by law.
No standard processing or cleaning fee is charged in connection with the statutory right of withdrawal. Any deduction must reflect an actual loss in value where the applicable legal requirements are met.
Exclusion of the Right of Withdrawal for Personalised or Custom-Made Goods
The statutory right of withdrawal does not apply, in particular, to contracts for the supply of goods that are not prefabricated and for whose production an individual choice or decision by the consumer is decisive, or which are clearly personalised to the consumer's individual needs.
This may apply in particular to products individually personalised, altered or specially made outside our regular product options at the customer's express request, for example through bespoke lettering, embroidery, design, fit alterations or another customer-specific modification.
Whether the right of withdrawal is excluded for a particular product depends on the applicable legal requirements. Where required, this will be stated for the relevant product before the contract is concluded.
Electronic Withdrawal Function
You may also withdraw from your contract using the “Withdraw from contract” function provided on our website.
After entering the required information, you can submit your withdrawal using the “Confirm withdrawal” function or an equivalently and clearly labelled button.
After successful submission, we will send you an acknowledgement of receipt of your withdrawal without undue delay on a durable medium, for example by email.
Use of the electronic withdrawal function is not mandatory. You may also exercise your statutory right of withdrawal by any other legally permitted means, including by sending us a clear statement by email.
Model Withdrawal Form
You may use our Model Withdrawal Form to exercise your right of withdrawal.
Use of the model withdrawal form is optional and is not a requirement for a valid withdrawal.
The form is available on our separate “Model Withdrawal Form” page.
Alternatively, you may use the electronic “Withdraw from contract” function or send us a clear withdrawal statement by email.
Returns and Exchanges
Independently of your statutory right of withdrawal, we also offer a regular returns and exchanges policy subject to our applicable conditions.
Different conditions may apply to this policy, for example regarding the condition of the goods, attached hangtags or voluntary exchanges.
Further details are available on our “Shipping & Returns” page.
Our voluntary returns and exchanges policy does not restrict your statutory right of withdrawal or your statutory rights relating to defective or non-conforming goods.
